Lexington Rollover Accident Attorneys

Rollovers are complex crash incidents that are particularly violent in nature. A rollover is when a vehicle turns all the way over on its roof or side in a crash accident. According to the National Highway Transportation Safety Administration (NHTSA), rollover accidents are the most dangerous type of vehicular crashes, accounting for the highest fatality rate. More than 10,000 people are killed every year in rollover accidents.

If you have survived such an incident and sustained injuries as a result of the crash, or have lost a loved one in such a crash, the Lexington rollover accident attorneys at Hare Wynn are here to help you face the complications of your case and will take on your legal burden while you focus on your recovery.

Causes of Rollover Accidents

More than other types of vehicle crashes, rollovers depend on the interaction of the driver, the vehicle, the roadway, and other factors. The type of vehicle, driver behavior, and environmental conditions can all contribute to rollover accidents. The NHTSA describes these as the main factors that cause a vehicle to rollover:

  • Alcohol – Almost half of all fatal rollover accidents involve alcohol. Any blood-alcohol concentration at all will negatively affect your ability to control your vehicle. Even a small amount of alcohol will impair your judgment, muscular coordination, and vision.
  • Driving behavior – Distraction and inattentiveness are significant factors in rollovers. Nearly 85 percent of all rollover fatalities are from single-vehicle crashes, and over 90 percent of those were involved in routine driving maneuvers at the time of the accident.
  • Location – Almost three-fourths of all fatal rollover crashes occur in rural areas where the speed limit is higher and where roads tend to be undivided and without barriers.
  • Speed – Some 40 percent of fatal rollover accidents involve excessive speeding and almost three-fourths of fatal rollovers took place where the speed limit was 55 miles per hour or over.
  • Vehicle Type – All makes and models of vehicles could roll over under the right conditions, but some types of vehicles are more susceptible to rollovers in a single-vehicle accident. Taller, narrower vehicles, such as SUV’s, pickups, and vans with higher centers of gravity have higher incidences of rollover crashes.

Many of these factors can be safely accounted for. When a driver fails to use reasonable care when consuming alcohol or increasing vehicle speed, he or she could be responsible for causing the accident.

Proper maintenance also plays a role. Adhering to standards of tire pressure and loading limits help to keep vehicles on the road. Each driver or vehicle owner is responsible for maintaining the safety of the vehicle. If they failed to take proper care, then they can be held negligent. If that negligence contributed to the accident that caused your injuries, then you have the right to recover compensation from them.

The attorneys at Hare Wynn believe that you should not carry the financial burden for someone else’s negligence. Contact us for a free consultation to discuss whether your accident could have been prevented, were it not for someone’s negligent driving.

Common Rollover Accident Injuries

Rollover accidents often cause the most devastating injuries, with possible disabilities and long-term effects. The majority of rollover crash victims sustain multiple injuries throughout the region of the head and neck, which are the most vulnerable areas. Common rollover injuries include:

  • Traumatic brain injury – TBI may result in impairment of speech, vision, memory, hearing, and emotional control.
  • Spinal cord injuries – These serious injuries can result in nerve damage and long-term back pain.
  • Broken bones and fractures – Fractures and breaks of hard bone can take a long time to heal and may require surgery.
  • Cuts and scrapes – Lacerations and abrasions can be deep and very painful.
  • Bumps and bruises – Organ bruising and hemorrhages can be especially dangerous.

Injuries sustained from rollover crashes are the result of slamming into another vehicle or other massive obstacle, impact with unsecured cargo, contact with broken pieces of metal or glass, being tossed from within the vehicle, or hitting the ground or another object after being ejected from the vehicle.

If you or your loved one is facing mounting piles of medical bills, lost wages, and other expenses related to a rollover accident that was not your fault, then you need to be compensated for your damages. The team at Hare Wynn is experienced at successfully obtaining compensation for survivors of rollover car accidents in the Lexington area. Call as soon as possible so that we can help you to relieve your financial stress and recover from your injuries.

Types of Rollovers

There are two different ways in which rollovers can occur: tripped or un-tripped. According to the NHTSA, 95 percent of single-vehicle rollovers are tripped. Rarely are vehicles involved in an un-tripped rollover crash.

Tripped

A vehicle trips when its wheels leave the roadway surface, sliding sideways and striking an object, such as a curb, rock, post, or guardrail. The tires could also dig sideways into softer soil to cause a tip. The sudden force applied to the tires causes the wheel side to shoot up and the vehicle to spin over onto its side or roof.

A tripped rollover can also occur when traveling at increasing speeds down a steep hill. A vehicle can roll over forward or sideways, tumbling down the incline if swerves too quickly or hits an object with its tire.

Un-tripped

This type of rollover usually occurs when the vehicle is top-heavy or tall. Swerving to avoid an obstacle can cause a top-heavy vehicle to flip over, especially at higher speeds. Vehicles that are wider and lower have a much lower risk of a rollover event.

There is a constant stream of developing systems designed to prevent rollover conditions and aid the driver to stay on the road during emergency situations. Electronic stability control, or dynamic stability control, is computerized technology that improves a vehicle’s stability. It can detect and reduce the wheels’ loss of traction on the roadway to prevent skidding, by automatically applying the brakes to maneuver the vehicle away from danger.

Rollover Accident Statistics

Because more deaths result from rollover crashes than any other type of vehicular accident, they are considered the most dangerous. The NHTSA has identified some alarming facts about rollover accidents in a 2010 study. Consider the following:

  • Rollovers accounted for nearly 35 percent of all deaths from passenger vehicle crashes.
  • Only 2.1 percent of the nearly 9.1 million passenger vehicle crashes involved a rollover.
  • More than 7,600 people died that year in rollover crashes.
  • Sixty-nine percent of those who died were not wearing seatbelts.

Surviving a traumatic event such as a rollover accident, or losing a loved one in such a crash can have lifelong emotional effects. The lawyers at Hare Wynn are compassionate and understand how stressful this time can be, and how confusing it can be to proceed with getting your life back.
