The Lexington Herald-Leader reported on October 11, 2019, that electric scooters were coming to Lexington, and that story came only a few months after the Courier-Journal reported on August 29, 2019, that Spin had launched 150 new e-scooters in Louisville after getting a probationary license from the city. On October 9, 2019, the scooter company Lime reported that people had taken more than 200,000 rides on Lime scooters since that company launched in November 2018.

Electric scooters are everywhere, and many view them as a convenient, eco-friendly method of getting around. Unfortunately, accidents on E-scooters can and do happen, whether from distracted drivers who fail to observe riders or inexperienced, inebriated, or reckless scooter riders behaving negligently. The scooter company could be held liable in specific instances, or the manufacturer of the scooter or scooter parts in others. It is crucial to hire an experienced lawyer to assist you if you’ve been hurt, because determining liability in these cases can be challenging. You’ll want a lawyer with the right experience, skill, and resources to help you get what you deserve.

Call Hare Wynn at (859) 550-2900 to speak with a Kentucky E-scooter accident lawyer right away. Our team knows how to handle these cases and we’re confident that we can secure a positive outcome for you and your family if you’ve been hurt. Our consultations are 100% free and if you hire us, we won’t charge you anything until we win your case.

Do I Need A Scooter Accident Lawyer?

Most insurance companies for negligent drivers are still likely to blame the scooter rider for the accident. Even when an insurer does not come out directly and state this, they will be actively working to find any way possible to deny or diminish your injury claim.

You will want to hire a skilled attorney to deal with insurers directly on your behalf. Your lawyer will investigate your accident and secure the evidence needed to demonstrate that another party was at fault for your accident. You will also want to have a lawyer if you happen to be injured in a scooter accident that does not involve a motor vehicle.

Isolated scooter crashes can occur because of defective scooters or possibly unsafe roadways. An attorney can assist you in possibly recovering compensation from the manufacturer of a defective part or a governmental agency responsible for maintaining a roadway.

There is also the possibility that you may be offered a lump sum settlement by an insurance company and told how you will be able to keep more money for yourself. Whatever you are being offered is probably a fraction of what you are actually entitled to, and a lawyer can negotiate for a far more just settlement or file a lawsuit when it is needed to get you the proper amount.

Types of Scooter Accident Cases We Handle

The scooter market in Kentucky is a competitive one, with Lime, Bird, and Spin being three of the biggest players. The five companies permitted to operate in Louisville are Lyft, HOPR, Spin, Jump, and Bolt. While these companies have been aggressive in getting scooters into cities, their scooters have also been involved in a very significant number of accidents.

On November 5, 2019, WKYT-TV reported that a man died after being struck by a vehicle while riding a Lime scooter on Richmond Road in Lexington. That same day, the Courier-Journal reported that a man died after falling off a Lime scooter and being run over by multiple vehicles near Lakeshore Drive. On October 26, 2019, the Lexington Herald-Leader reported that a man was struck by a vehicle while riding a Lime scooter and suffered injuries that were not life-threatening, but the driver was charged with DUI.

The Courier-Journal reported that while Bird scooter injuries were beginning to tally up in many other cities around the nation, Norton Hospital and the University of Louisville Hospital both said they had not seen a trend of scooter injuries. WAVE-TV reported that Bird scooters returning to Louisville would come with an increase in injuries and cited the story of one man who broke his jaw while riding a Bird scooter.

In June 2019, WTVQ-TV reported that Spin was ending its bike program in Kentucky and replacing them with e-scooters because the scooters make more money. Louisville got 150 more e-scooters when Spin launched there in August 2019.

Austin Public Health and the Centers for Disease Control and Prevention (CDC) published the Dockless Electric Scooter-Related Injuries study in April 2019 that identified 271 persons with potential scooter-related injuries in Austin, Texas between September 5, 2018, and November 30, 2018. There were 80 riders with severe injuries that included:

  • 84 percent of victims suffered bone fractures
  • 45 percent suffering nerve, tendon, or ligament injuries
  • 8 percent forced to spend more than 48 hours in a hospital
  • 5 percent experienced severe bleeding
  • 1 percent involved organ damage.

Nearly half of riders in the study suffered head injuries, but fewer than 1 percent wore helmets. In February 2019, Consumer Reports reported that its own investigation found 1,500 people all over the United States injured in scooter crashes since late 2017, but scooter companies provided no injury or crash figures.

The Consumer Reports story also stated that many hospitals still do not track scooter accident injuries, with some figures provided being educated estimates from medical directors. Consumer Reports did note that several hospitals have kept detailed records to try to better understand the trend.

Scooter accidents may stem from certain road hazards such as potholes, debris in the road, or uneven pavement. There are also accidents in which scooters malfunction, with failing brakes, wheels locking, or handlebars even becoming attached.

Common kinds of driver negligence that can cause a scooter accident include, but are not limited to:

  • Misjudgement of scooter speed or distance
  • Obstructed bike lanes
  • Speeding
  • Distracted driving
  • Failure to yield
  • Sideswipe accidents
  • Left-turn accidents
  • Driving under the influence (DUI) of drugs or alcohol

Scooter accidents often have the potential to cause severe injuries, with head trauma such as traumatic brain injuries (TBIs) often being one of the most common kinds of serious injuries. A TBI can lead to a lifetime of challenges for victims.

People can also suffer injuries that at least offer some hope of recovery, such as road rash, muscle sprains, strains, fractures, and lacerations. Many other injuries, however, can also involve far longer periods of recovery that can last many years, and these injuries may include spinal cord injuries or paralysis.

When a person is killed in an e-scooter accident, the family of the deceased person should strongly consider filing a wrongful death lawsuit. A negligent motor vehicle driver or possibly a scooter rental company or manufacturer could be liable in such cases.
